Tobacco and Vapes Act 2026: What does it mean for vape waste management?
The ban on sale and supply of single-use vapes came into effect in June 2025 and applies to all sellers and suppliers. The ban was introduced to address growing environmental concerns surrounding waste and the increasing number of fires from incorrectly disposed lithium-ion batteries within the vapes. Despite the ban, over 6.3 million vapes and pods are still thrown away every week in the UK.
The UK’s regulatory landscape has continued to evolve, and since the ban on single-use vapes came into force over a year ago, the Tobacco and Vapes Act 2026 has also been announced. What is the Tobacco and Vapes Act 2026
The Tobacco & Vapes Act was passed into law in April 2026 and introduces a range of measures designed to reduce smoking and youth vaping. Different elements of the Act will be introduced over time, beginning in January 2027.
This will make it illegal to sell tobacco products, vapes and nicotine products to anyone born on or after 1 January 2009, with the aim of creating a smoke-free generation. Michelle Mitchell, Chief Executive Officer at Cancer Research UK, commented: “This is a truly historic achievement that will help to save and improve lives. With the new law in place, we are moving towards a future where children will grow up shielded from the life-long harms of tobacco. It will mean more people living a life free from the grip of deadly addiction, fewer people facing a cancer diagnosis and less pressure on an already overstretched health service.”
It also includes measures to ban the advertising and sponsorship of vapes and nicotine products, as well as powers to restrict their packaging, branding and displays that are designed to appeal to children. This means retailers, manufacturers and suppliers cannot promote these products both on site, or online.
Retailers will be subject to a new mandatory licensing scheme, including a personal and premises licence, increasing regulatory oversight of vape operations.
How does this affect vape recycling?
Whilst the Tobacco and Vapes Act 2026 does not directly impact existing or introduce new vape recycling requirements, it forms part of a wider tightening of regulations around vape products, making it increasingly important for retailers to have robust and compliant processes in place for managing vape waste.
